Hackensack Drug Crimes Lawyer Adam M. Lustberg Explains Possession of Mushrooms as a Crime in NJ

According to the Hackensack drug crimes lawyer, “While hallucinogenic mushrooms are still considered Schedule 1 drugs in New Jersey, possession of small amounts has been reclassified. Now, instead of being charged with possession of a controlled substance, if you have been found with one ounce or less of these mushrooms, the most stringent penalty will be six months in jail and a maximum fine of $1,000 under the new classification.”
The lawyer explains that the federal government banned “psychedelic” mushrooms as part of the effort to put a halt to recreational drug use in 1970. Unfortunately, this “war on drugs” has been ineffective and expensive and often targets the lowest-level offenders.
Attorney Adam M. Lustberg adds that Hallucinogenic mushrooms contain a compound called psilocybin. This compound has psychoactive effects and has been considered a Schedule I drug under the Controlled Substances Act. But in New Jersey, this drug is classified with other more harmful drugs.
In the article, attorney Lustberg says that some states and cities around the country have decriminalizes these mushrooms and make them a low priority for law enforcement. New Jersey considers carrying and selling hallucinogenic mushrooms a criminal offense. However, as of February 2021, possessing less than an ounce of these mushrooms is considered a disorderly person's offense.
According to the defense attorney, “Possession of a Schedule I controlled dangerous substance, of which mushrooms are still considered, can be charged and prosecuted as a third-degree offense. If you are found with over an ounce of these mushrooms, you can still face up to 5 years in prison and fines of up to $35,000. Furthermore, you will have a criminal record that may follow you for the rest of your life.”
